On July 7, 2026, Senior Partner Andres Baltodano and Senior Appellate Partner Daniel Weinger obtained a dismissal with prejudice in a tragic wrongful death negligent security case arising from the shooting death of a toddler at a Broward County apartment community. The case involved an eight-figure demand.
The plaintiff alleged that the apartment complex should be held liable because the firearm owner was a convicted felon who allegedly should not have been residing on the property. On behalf of the apartment complex, we challenged the legal sufficiency of the complaint at the responsive pleading stage, arguing that the alleged facts could not establish a viable cause of action and that any further amendment would be futile.
The court dismissed the action with prejudice, specifically finding that any further amendment would be futile.
