Tallahassee Associate Tabitha Jackson, Esq., recently triumphed in a matter styled Micah Thompson v. The Board of Trustees for the Florida State University, et al., a Leon County suit brought by a former arrestee. Plaintiff brought a three-count suit against the FSU police for an arrest for driving under the influence. Specifically, the Counts included False Arrest, False Imprisonment, and Malicious Prosecution. Plaintiff argued that because the charges ended in a Nolle Prosequi, an entitlement to damages arose. Defendant argued in turn that not only was probable cause present during the arrest, as Plaintiff was speeding, failed the field sobriety test, and had an open bottle of vodka in his car, but also that FSU, as well as all officers involved, were all cloaked with immunity under Trianon Park Condo.
