Biography
Daniel S. Weinger, Esq., is the Managing Attorney for the firm's Appellate and Trial Support Division. He provides strategic guidance and high-level legal analysis in complex insurance defense matters throughout all stages of litigation. Drawing on extensive experience in appellate practice and civil litigation, Daniel works closely with the firm’s attorneys to develop case strategies, evaluate dispositive motions, and address sophisticated legal issues that arise in high-exposure and procedurally complex cases.
Daniel regularly advises trial counsel on preservation of appellate issues, motion practice, evidentiary matters, and legal research critical to case development and risk assessment. He has played an integral role in successfully obtaining summary judgment in numerous cases involving premises liability, construction defects, professional liability, motor vehicle accidents, and other complex civil claims.
Recently, Daniel has helped secure favorable summary judgment rulings in several negligent security matters by developing targeted legal strategies focused on foreseeability, causation, and the absence of prior substantially similar criminal incidents. Working closely with trial teams, Daniel assists in crafting dispositive motions that effectively limit liability exposure for property owners, management companies, commercial clients, and individuals facing high-stakes claims. These successes reflect Daniel’s ability to analyze complex factual records, identify dispositive legal issues, and position cases for early resolution.
In addition to overseeing appellate strategy and litigation support initiatives, Daniel collaborates with attorneys across practice groups to craft persuasive legal arguments, analyze emerging legal trends, and provide practical solutions tailored to client objectives. His ability to synthesize complex legal issues and develop effective litigation strategies has made him a valued resource within the firm and a trusted advisor to both attorneys and clients.
Before joining the firm, Daniel gained substantial experience in both the public and private sector. Daniel served as a Career Attorney for the Third District Court of Appeal for six years. In this capacity, Daniel worked directly for and advised distinguished members of Florida’s judiciary, including the Honorable Alan R. Schwartz, the Honorable Joseph Nesbitt, the Honorable James R. Jorgenson, the Honorable Gerald B. Cope, the Honorable David L. Levy, the Honorable Mario P. Goderich, the Honorable Juan Ramirez, Jr., the Honorable Frank A. Shepard, the Honorable Thomas H. Barkdull, Jr., as well as several visiting judges from across the State. The experience provided Daniel with insight into the various methods that different judges apply when deciding a case on appeal.
Following his tenure at the Third District Court of Appeal, Daniel worked as lead appellate counsel for various private practices including as Principal of his own Law firm. Daniel was also an Adjunct Professor at Nova Southeastern University’ Shepard Broad Law Center where he taught Civil Pre-Trial Practice and at Florida Atlantic University where he has taught Business Law and Business Ethics both to undergraduates and to MBA candidates.
Daniel earned his Bachelor of Arts degree in Accounting from Florida Atlantic University. He obtained his Juris Doctor from Nova Southeastern University, graduating magna cum laude, class rank top 5%.
Daniel is admitted in Florida (1999). He is also admitted to the United States District Court for the Southern District of Florida (2000), and to the United States Circuit Court of Appeals for the Ninth and Eleventh Judicial Circuits (2010).
